Employers are within their rights to carry out workplace observations such as employee surveillance to assess employment sickness, given that they act in accordance with legal legislation. So in some cases employees may be kept under surveillance while on legitimate leave, but it’s the employees who take advantage of their management who are causing employers to take action this way.
